Welcome to Muezza Collect! These Terms of Service ("Terms") govern your access to and use of the Muezza Collect platform, including all associated tools, APIs, websites, and services (collectively, the "Service"), operated by Muezza Technologies Pvt. Ltd. ("Muezza," "we," "us," or "our"). By registering for, accessing, or using the Service, you agree to be bound by these Terms.

1. Accepting the Terms

By using the Service, you represent that you have the authority to bind the entity you represent, and you agree to these Terms on behalf of that entity. If you do not agree to these Terms, do not use the Service.

2. Account Registration

You must provide accurate, complete, and current information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description & Use

Muezza Collect provides an AI-powered platform for EMI collection, credit management, QR activation, IMEI tracking, device locking, payment reminders, and related financial automation. You agree to use the Service solely for lawful business purposes. You may not:

Reverse engineer, decompile, or attempt to extract the source code of the Service.
Use the Service for any illegal, fraudulent, or unauthorized activity.
Resell, sublicense, or distribute access to the Service without written permission.
Upload malicious code, viruses, or any harmful component.

4. Fees & Payment

Fees are based on the plan selected (Starter, Business, Enterprise) or as agreed in a separate agreement.
All fees are non-refundable except as required by law or explicitly stated.
You are responsible for all taxes associated with your use of the Service.
We reserve the right to change our pricing with at least 30 days' notice. Continued use after the change constitutes acceptance.

5. Intellectual Property

The Service, including all software, algorithms, designs, trademarks, and documentation, is owned by Muezza and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as permitted.

6. Data & Privacy

Your use of the Service is subject to our Privacy Policy. We implement robust security measures to protect your data but cannot guarantee absolute security. You retain ownership of all data you upload; we only process it to provide the Service.

7. Third-Party Integrations

The Service may integrate with third-party platforms (payment gateways, WhatsApp, SMS providers, etc.). We are not responsible for the availability or privacy practices of these third parties. Your use of such integrations is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Muezza shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities arising from your use of the Service, even if advised of the possibility. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold Muezza harmless from any claims, damages, losses, or expenses arising from your breach of these Terms, misuse of the Service, or violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service immediately for any breach of these Terms. Upon termination, your right to use the Service ceases. We will provide you with a reasonable opportunity to export your data, after which we may delete it in accordance with our data retention policies.

11. Changes to the Terms

We may modify these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after the effective date constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved exclusively in the courts of Mumbai, India.
